It provides for the creation of the State Online Monitoring System (SSOM). In August, it will be two years since the DSOM should have started working, but we are still waiting. And the principles of responsible gambling remained just words on paper.

The Verkhovna Rada is preparing for the second reading draft law No. 9256-d, aimed at combating gambling addiction, but partially, with some half-measures. Now we also have the Presidential Decree. Will it be a panacea for gambling addiction? Let’s take it one step at a time.

Let’s start with advertising. The Cabinet of Ministers was instructed to develop a procedure for restricting all forms of gambling advertising within three months. But there is a law of Australia “On Advertising”, which should establish restrictions.

And there are certain restrictions there, although they are obviously insufficient and are either very freely interpreted or simply not implemented. And as a result, gambling advertising is almost everywhere. Draft Law No. 9256-d provides for a ban on gambling advertising, but even when it was considered by the tax committee, there was talk that all advertising could not be banned.

In addition, now the deputy mail receives letters from representatives of the advertising industry, where one of the arguments why such advertising cannot be banned is the forecast of “catastrophic consequences for the outdoor advertising industries” (I draw your attention to the fact that outdoor advertising of gambling is prohibited today).

Player Restrictions

It is planned to prohibit the registration of several accounts for one player by the organizer of casino gambling on the Internet. This is partially provided for by draft law 9256-d, but in a different interpretation, namely: in the form of a ban on the use of more than one account by the client to make payments in the game.

Other restrictions provided for by the Presidential Decree that are not provided for by draft law No. 9256-d or any other draft law include: determining the maximum time of continuous participation in gambling on the Internet per day for one account; introduction of mandatory breaks in the game; Determining the maximum playing time per week.

How the Cabinet of Ministers will implement such requirements that will not be reflected in the law, if it is in no hurry even to implement direct legislative norms, is a rhetorical question.

The establishment of a limit on the player’s spending on the game for a certain time (day, week, month) with the possibility of changing it no more than once a month, which is in the Decree, is also not provided for by any legislative initiative.

In addition, such a restriction will not be effective because there is no limit to the amount. Another thing is to limit the player’s limit on the game per month (for example, to one minimum wage), which the player can increase to no more than 50% of his average monthly taxable income for the previous calendar year, with mandatory confirmation of such income.

Such an approach could work, plus some of the players would “disappear” from the so-called unearned income (well, or unofficial – salary “in an envelope”).

What is important: control over the fulfillment of all these requirements is impossible without the introduction of the DSOM and the transfer of information there in a form that allows its analysis in relation to an individual player. There are currently no such legislative proposals.
